P.R.C. Supreme People's Court Interpret Issues Concerning Application of P.R.C Contract Law
The Supreme People's Court (Court) released on April 24, 2009 the Interpretations to the Several Issues Concerning Application of the Contract Law of the People's Republic of China (II) (Interpretations), which shall take effect as of May 13, 2009.
Under the Interpretations, for contracts which are signed in written form, if the place where the contracts are signed or sealed is different from that as agreed by the contracts, the people's court shall recognize the place as agreed by the contracts as the signing place.
The Interpretations also stipulated that if the debtors give up the undue debts or the debt guarantee, or purposely extend the implementation term of the due debts, and the debtees who are harmed by such behaviors raise lawsuits concerning the right of revocation in accordance with the provisions, the people's court shall support such lawsuit.
