China's State Administration for Industry & Commerce (SAIC) stipulated, in the Rules for Recognition of Well-known Trademarks (Rules) on April 21, 2009, that such factors as the trademarks' popularity in the public, continuous use of the trademarks must be considered when cognizing well-known trademarks.
Under the Rules, it is unnecessary to meet all the aforementioned factors for recognizing a well-known trademark. The Rules also stipulated that any unit or individual is entitled to provide feedbacks to the trademark bureau and trademark appraisal commission when trademarks to be recognized are under the examination.
Besides, Supreme People's Court also released on April 26, 2009 the Interpretations of the Supreme People's Court on Several Issues Concerning the Protection of Well-known Trademarks in such Hearing of Civil Disputes (Interpretations), which made regulations from five aspects, including concept of well-known trademarks, applicable ranges of judicial cognizance of well-known trademarks, factors of the cognizance and etc. The Interpretations shall take effect as of May 1, 2009.
